Foreign nationals must be enrolled in a program to maintain M-1 status. Upon completion of the program students have 30 days to depart the U.S.

On Aug. 9, 2018 USCIS issued a policy memorandum (Accrual of Unlawful Presence and F, J, and M Nonimmigrants) changing how the agency calculates unlawful presence for students and exchange visitors in F, J, and M non-immigrant status, including F-2, J-2, and M-2 dependents, who fail to maintain status in the United States.

    To apply for Practical Training, you must:

    • Complete your studies and receive your certificate or diploma.
    • Obtain a recommendation from your Designated School Official (DSO) for practical training.
    • Submit Form I-765, “Application for Employment Authorization,” along with the required fee and supporting documents to USCIS.
    • Receive your Employment Authorization Document (EAD) from USCIS before you begin working.

    Can I travel outside the U.S. while on an M-1 Visa?

    Yes, you can travel outside the U.S. while on an M-1 Visa. Ensure that you have:

    • A valid passport and M-1 Visa.

    • Documentation of your enrollment status.

    Can I extend my M-1 Visa?
